When you say “me and my kids” do you mean the children are his also? Or are the kids that were dropped from a different man? Anyways, he cannot drop you from coverage until you are legally divorced. He definitely cannot drop his biological children from his insurance, especially if you are unable to provide health insurance for them.
This is tricky. Even if the children are not his, he still cannot drop them from his insurance. Just remember the saying “for the best interests of the children”. I am about 98% confident that the court would tell him to put the children back on his insurance even if they are not his. I am also certain that he cannot take you off of his insurance until you are legally divorced.
Definitely hire an attorney to sort that out. You don’t want your kids being without health insurance.

Yes but it’s going to be proof as far as a judge is concerned that he’s an unfit parent and won’t be supportive of his children unless he as the judge orders it. So bad move on his part.

Yes, unfortunately, he can do that. Since he was the one carrying you on the insurance, you’re not entitled to notification.
It was very mean of him to drop the kids. Make sure there is a provision for medical and dental insurance in the divorce decree, and in the meantime, make sure he gets sent all the unpaid medical bills. He’s divorcing you, not the kids.

unfortunately, if he did it at open enrollment time, i’m pretty sure that he could make the change. now, it’s definitely a scumball move to do so to you and more so those kids without telling you, but nonetheless it looks like it’s happening. you might want to think about getting your own coverage through your job.

People do this all the time, it is not right, it happend to me..but I had other insurance in place at the time. You could seek legal advise in what to do about it. Enroll in your own insurance, all states offer health insurance to low income familiies if this is your case.

GFet lawyer to go to xcourt to have it totally reinstated with penalites to him, plus damages to you, and make sure the judge really reoprimands him…also, that is considered child and spousal abuser so have him arrested with the lawyer’s help./

Yes he can. However this will come back to haunt him in court because chances are he will be court ordered to maintain insurance on the children. This type of action shows him to be acting irresponsibly toward his children. Judges tend to not like that!

He can. But once you get a divorce and you become the custodial parent, then he would be forced to have coverage for the children but not you.
